Terms of Use

Please read these Terms of Use ("Terms", "Agreement", "EULA") carefully before using the Forsoka Culinary Arts family of applications - Cookbook, Home & Family, Family and Chore Calendar, Plate Ponder, Family Ponder, Family Ponder Kids, Shake it!, Kitchen Unit Converter, Kitchen Timers, Plate Scanner, Recipe Scanner, Forsoka Culinary Arts and TO DO / SHOPPING LIST - and the related website services (together the "Service", "App" or "Licensed Application") operated by Forsoka Culinary Arts LLC ("Forsoka Culinary Arts", "we", "us").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service.

Medical and Health Disclaimer: Not a Medical Device

1. General Wellness Use Only. The Service is a set of general wellness and kitchen applications intended solely for informational, educational and general lifestyle purposes. The Service is NOT a medical device, has not been cleared or evaluated by the U.S. Food and Drug Administration (FDA), and is not intended to diagnose, treat, cure, mitigate or prevent any disease, illness or medical condition.

2. No Medical Advice. Nothing in the Service constitutes medical advice, clinical guidance or professional healthcare services. That includes calorie, portion and nutrient estimates in Plate Ponder, Plate Scanner and Cookbook, nutrition scores and ingredient alerts in Forsoka Culinary Arts, AI-generated summaries and "healthier alternative" recommendations, and any suggestion sent to you through Plate Ponder by a coach you have invited. Estimates made from a photograph are approximations. The information provided by the Service should never be used as a substitute for professional medical judgment.

3. Assumption of Risk. Any dietary changes, product swaps or purchasing decisions made on the basis of information or recommendations from the Service are made entirely at your own risk. You acknowledge that AI-generated output and crowdsourced data may contain errors, inaccuracies or omissions.

4. Consult a Healthcare Professional. If you have specific health concerns, allergies, dietary restrictions (such as hypertension, diabetes or celiac disease) or questions about how a food affects a medical condition, consult a qualified healthcare provider. Never disregard or delay seeking professional medical advice because of information from the Service.

Eligibility

Age requirements differ by app. Home & Family and Family and Chore Calendar are made for households: a parent or guardian sets them up and is responsible for the family board, and children use them on the parent's device under the parent's supervision. Plate Ponder and Plate Scanner require you to be at least 16. Shake it! requires you to be of legal drinking age where you live. Forsoka Culinary Arts requires you to be at least 18. By using an app you affirm that you meet its requirement.

Identity, Not Accounts

The Service has no user accounts. An anonymous identity is created on your device and shared by the Forsoka Culinary Arts apps on it; an optional email address lets a second device recover your data. You are responsible for the devices that hold your identity and for anyone you let use them, and for any share link, share code or family join link you hand out: whoever holds it can use it.

Your Data and Backup

The apps are built so that your recipes, boards, lists and diary live on your own devices and work without our server. Where an app offers backup, our server keeps a copy so a new device can recover it, and we take reasonable care of that copy, but it is a convenience and not an archive. We do not guarantee that a copy will be available at any given moment, and if you keep no other copy we cannot recover what a lost device held. Turning on backup, and recovering it to a second device, is the way to keep a copy of your own, and on request we return what we hold for you as a file.

License Grant

The App is licensed, not sold, to you. Forsoka Culinary Arts grants you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to these Terms and the applicable app store rules. You may not distribute, reverse-engineer, decompile, modify or create derivative works of the App software.

Forsoka Culinary Arts Plus

When offered, Forsoka Culinary Arts Plus is a single subscription that unlocks its features in every app in the family that sells it. It is bought through Apple, Google, Amazon or, on Windows, through our merchant of record, renews automatically until cancelled, and is cancelled or refunded through the store you bought it from under that store's rules. Prices may differ by store and country. Features that are free today may become part of Plus in a later version; anything you have created stays yours and stays accessible.

Your Content & Photo Training License

The Service allows you to create, upload, store and share content - recipes, meal plans, family boards, food diaries, drink recipes, photos of recipe cards, cookbook pages, plates and products, packaging and label images, reviews, ratings, price reports and comments ("Your Content").

Ownership: You retain ownership of Your Content.

License to Forsoka Culinary Arts: In order to operate, provide, promote and improve the Service, you grant Forsoka Culinary Arts a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, cache, reproduce, process, adapt, publish and display Your Content in connection with the Service. For a recipe you share with everyone through Global search, that includes showing it to every user until you withdraw it.

Photo Retention & AI Training License: Specifically regarding photos you upload or capture through the Service (including product, packaging, barcode, label, pantry, recipe-card, cookbook-page and plate photos), you grant Forsoka Culinary Arts a perpetual, irrevocable, worldwide, royalty-free license to retain, process, analyse and use such photos to train, fine-tune, evaluate, develop and improve artificial-intelligence, machine-learning, computer-vision and recognition models. This training license survives the deletion of your data, provided that any retained photos are disassociated from your identity.

Open & Closed Database Contributions (Pantry Ponder): You grant Forsoka Culinary Arts the right to submit, contribute, sub-license, distribute and publish anonymised product details, barcode data, nutrition facts and product images to open database projects (such as Open Food Facts, under open database licenses such as ODbL or CC-BY-SA), open dataset repositories, and closed or commercial databases, catalogue partners and AI research datasets. This does not apply to recipes, diaries or family boards.

Scanned and imported recipes: When you photograph a page from a published cookbook or magazine, or import a recipe from a web page, you do so for your own personal use. You are responsible for what you share onward, including through a share link, a share code or Global search, and you must not publish content you do not have the right to publish.

You represent and warrant that you own or have all necessary rights to submit Your Content and that Your Content does not violate any third-party rights or applicable laws.

Sharing with Others

A recipe shared as a link travels inside the link and can be opened by anyone who has it. A share code shows your whole cookbook to anyone who enters it until you replace the code. A family join link admits a device to your family board. Plate Ponder circles see daily totals only; a coach you invite is a person you have chosen, not a service we provide, and any relationship, advice or fee between you and a coach is between the two of you. We are not a party to it and take no responsibility for it.

AI & Recognition Features

Parts of the Service use automated artificial-intelligence and computer-vision systems to read recipes from photographs, identify foods on a plate, identify products, parse ingredients and nutrition facts, or generate summaries. AI output is provided "as is" for informational purposes only and may misread a quantity, a step or an ingredient. Check a recipe before you cook from it, and always verify nutrition, allergen and ingredient information on the physical packaging before consumption.

Kitchen Timers

Kitchen Timers and the timers inside Cookbook and Home & Family are conveniences. An alarm can be missed, silenced by the device or delayed by the operating system. Do not rely on them for anything where a missed alarm could cause injury or damage; stay with what is on the stove.

Shake it!

Shake it! is a recipe book for alcoholic and non-alcoholic drinks and is intended for people of legal drinking age. Drink responsibly and never drive after drinking.

Community Guidelines & Reviews

Reviews and ratings in Forsoka Culinary Arts must reflect genuine shopping experiences. Recipes shared through Global search must be recipes. You agree not to post fake reviews, commercial advertisements, spam, defamatory material, offensive content or misleading information. We reserve the right to review, edit, remove or restrict any shared content at our sole discretion.

Prohibited Activities

You agree not to:

  1. Systematically scrape, mine or extract data or content from the Service to compile a database or directory without our prior written permission.
  2. Use automated scripts, bots or scrapers to access the Service or submit content.
  3. Interfere with, disrupt or place an unreasonable load on the Service infrastructure, including the scanning services.
  4. Bypass or attempt to circumvent security, access restrictions or usage allowances of the Service.
  5. Impersonate another person or misrepresent your affiliation.
  6. Upload viruses, malicious code or harmful components.
  7. Use the Service for any unlawful or unauthorised purpose.

Intellectual Property Rights

All rights, title and interest in and to the Service (excluding Your Content), including app software, designs, text, graphics, logos, trademarks, and the recipe, food and drink catalogues we provide, are the exclusive property of Forsoka Culinary Arts LLC and its licensors.

Feedback

Any suggestions, feedback or ideas you submit regarding Forsoka Culinary Arts shall become the sole property of Forsoka Culinary Arts LLC without obligation or compensation to you.

Privacy Policy

Our Privacy Policy (and, for TO DO / SHOPPING LIST, its own policy) is incorporated into these Terms. By using the Service, you consent to the data practices described there.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. FORSOKA CULINARY ARTS DOES NOT WARRANT THAT RECIPES, CALORIE OR NUTRIENT ESTIMATES, PRODUCT REVIEWS, INGREDIENT DATA, ALLERGEN INFORMATION, BARCODE MATCHES OR TIMER ALARMS ARE ACCURATE, COMPLETE, TIMELY OR ERROR-FREE, OR THAT BACKUPS WILL NEVER BE LOST.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORSOKA CULINARY ARTS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50.00) AND THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Notice Regarding Apple, Google, Amazon and Microsoft

These Terms are between you and Forsoka Culinary Arts LLC only, not Apple Inc., Google LLC, Amazon.com, Inc. or Microsoft Corporation. The store you obtained the App from is not responsible for the App or its content, maintenance or support, and has no obligation to furnish maintenance or support services for it.

Governance

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, USA, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Fairfax County, Virginia.

Termination

You may stop using the Service at any time and delete your data from inside any app. We reserve the right to suspend or terminate access to the Service at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users or the Service.

Changes to Terms

We reserve the right to modify these Terms at any time. We will post revised Terms on this page with an updated date. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
